What is incapacity for work?
It is the situation in which a worker is unable to perform his or her tasks or functions in his or her job.
There are different types of incapacity, depending on the degree and scope of the incapacity. Social Security defines these disabilities based on a series of requirements. The following is a description of the different existing disabilities.

Types of occupational disabilities
Temporary disability
This is the situation in which a worker, for health reasons, is temporarily unable to perform the functions of his job, although it is foreseen that there may be an improvement and/or cure that will allow him to return to his job.
In the case of an occupational sick leave, it will be managed by the mutual insurance company, while if it is a common sick leave, it will be managed by the social security (INSS).
Colloquially it is what is known as “medical leave” or “being on sick leave”. These temporary incapacities can be of two kinds:
- Common Contingencies
- Contingencias Profesionales
Permanent disability
A permanent disability is a situation in which a working person for health reasons is unable to perform one or all of the functions for which he/she has been hired on a lasting basis, i.e. the health problems are not temporary or can be reversed.
There are different types of permanent disabilities:
- Partial Permanent disability for usual profession
- Total Permanent disability for usual profession
- Absolute Permanent disability for any work
- Permanent disability, contributory modality
- Permanent disability of self-employed workers

Occupational diseases are considered to be those that originate as a consequence of the development of an occupational or professional activity.
